2. What data we process and why
a) Booking request and booking
When you request a property via the form we process the property, travel period, number and ages of travellers, name, email address, phone number, postal address, your message and technical data (IP address, time). The purpose is to check and answer your request and to conclude and perform the accommodation contract including invoicing. Legal basis: Art 6 (1) b GDPR (contract or pre-contractual measures); for invoice data Art 6 (1) c GDPR (tax retention obligation, § 132 Austrian Federal Fiscal Code – 7 years). We delete booking data no later than three years after the end of your stay unless a statutory retention period applies; declined or cancelled requests after one year.
b) Guest registration and visitor tax
Under the Vorarlberg Registration Act and Tourism Act we are obliged to keep a registration form for all guests (name, date of birth, nationality, home address, ID data, arrival and departure) and to pass the visitor tax on to the municipality of St. Gallenkirch. Legal basis: Art 6 (1) c GDPR. The data are transmitted to the municipality or the registration system and retained for the statutory periods.
The data are collected via our online form (link in the booking confirmation) and transmitted automatically to the municipality’s registration system (feratel Deskline WebClient, operated by feratel media technologies AG, Villach, on behalf of Montafon Tourismus GmbH). On the day of arrival you confirm the details online and sign the registration form electronically; we store the signature as an image for the statutory retention period. The Montafon Card (name, date of birth and e-mail address passed to Montafon Tourismus) is issued only with your voluntary consent (Art 6 (1) a GDPR), which you give in the form and may withdraw at any time. We retain the guest registration data (including those of fellow travellers) for seven years as required by the Austrian Registration Act and delete them afterwards.
c) Contact form and email
When you contact us we process your name, email address, optionally your phone number and your message in order to reply (Art 6 (1) b and f GDPR). We delete messages once the matter is settled, at the latest after one year.
d) Email dispatch
Confirmations, invoices and information about your booking are sent by email via the mail server of our hosting provider (easyname GmbH, Vienna, Austria). We do not send newsletters.
e) Server logs and security
When you visit the website, our hosting provider's web server automatically stores IP address, date and time, requested page, referrer and browser identifier in log files. These serve security and error analysis (Art 6 (1) f GDPR) and are deleted after a short time. Forms are protected by security tokens and a spam-protection field.
f) Cookies and local storage
This website sets one technically necessary session cookie (form and security functions, administration area). In your browser's local storage (localStorage) we remember – without transmitting anything to us – your consent to loading maps, your answers in the leisure guide and your favourites list. No tracking or analytics cookies are set and no third-party statistics services are embedded.
g) Maps (OpenStreetMap)
Maps are only loaded when you click "Load map". Your browser then fetches map tiles from the servers of the OpenStreetMap Foundation (St John's Innovation Centre, Cambridge, United Kingdom); your IP address and browser identifier are transmitted. Legal basis is your consent (Art 6 (1) a GDPR), which you can withdraw by deleting the website data in your browser. Privacy information: osmfoundation.org. If you switch on the optional layers "Official hiking trails", "Winter hiking trails" or "Mountain bike routes", your browser fetches map images from the geoserver of the State of Vorarlberg (vogis.cnv.at, Office of the Vorarlberg State Government, Bregenz, Austria); your IP address is transmitted in this case as well. The PDF documents contain map images generated on our server; no data of yours are transmitted to third parties in the process.
h) Calendar synchronisation with booking portals
To avoid double bookings we exchange only occupancy periods – no names or contact details – with booking portals (e.g. Airbnb, Booking.com) on which the properties are also offered.
3. Recipients
Hosting and email: easyname GmbH, Fernkorngasse 10, 1100 Vienna (processor). Municipality of St. Gallenkirch (guest registration, visitor tax). Tax advisor and tax authorities within statutory obligations. Transfers to third countries only occur when loading maps (see 2 g).
4. Your rights
You have the right to access, rectification, erasure, restriction of processing, data portability and objection, as well as the right to withdraw consent at any time. Please use the contact details above. If you believe that the processing of your data violates data protection law, you may lodge a complaint with the Austrian Data Protection Authority: Barichgasse 40–42, 1030 Vienna, dsb.gv.at.
5. No automated decision-making
We make no automated individual decisions and carry out no profiling. The suggestions of the leisure guide are calculated exclusively in your browser from your input.
